At Open Time Clock, we want to give you the best possible experience. To do this we process some personal data about you to understand your needs and interests and to develop the best services and features for you and all of our customers. But, be assured, your privacy and the security of your personal data are very important to us. Open Time Clock is absolutely committed to your privacy in any aspect and guards your personal and business information to the best of our capabilities. We know and see that the great and exciting growth of the Internet and all the types of online services has also brought reasonable concern for consumers about what information is collected, distributed and available about them, and we want you to be sure that we always consider and work with that diligent and honest commitment to all of our Internet activities.

The purpose of this Privacy Center is to give you more information about the rights and controls you have in relation to your personal data, and to highlight some important sections of our Privacy Policy to you.

Open Time Clock and FERPA

For school customers / education organizations, data collected by Open Time Clock includes Student Data from education records that are subject to the Family Educational Rights and Privacy Act, “FERPA”, ("FERPA Records"), including student names, email, Messages, and work/class attendances. To the extent that Student Data includes FERPA Records, you designate Open Time Clock as a "School Official" (as that term is used in FERPA and its implementing regulations) under the direct control of the school with regard to the use and maintenance of the FERPA Records and Open Time Clock agrees to comply with FERPA.

Open Time Clock and GDPR

Open Time Clock complies with the GDPR and allows residents of the EU, UK, and Switzerland to exercise their rights described in that regulation. The purposes for which Open Time Clock collects your information, the categories and specific types of information, and our practices and policies regarding the processing of your information are described in this Privacy Policy and our Data Processing Agreement.

Open Time Clock and HIPAA

Open Time Clock complies with the HIPAA. The HIPAA Privacy Rule establishes national standards to protect individuals' medical records and other individually identifiable health information (collectively defined as “protected health information”) and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically. The Rule requires appropriate safeguards to protect the privacy of protected health information and sets limits and conditions on the uses and disclosures that may be made of such information without an individual’s authorization. The Rule also gives individuals rights over their protected health information, including rights to examine and obtain a copy of their health records, to direct a covered entity to transmit to a third party an electronic copy of their protected health information in an electronic health record, and to request corrections.

What personal data does Open Time Clock collect about me?

It is very important to us that you understand what personal data we collect about you, how we collect it, and why it’s necessary.

We collect your personal data in the following ways:

1. Personal data collected when you sign up for the Open Time Clock Service - when you sign up to the Open Time Clock Service, we collect certain personal data so you can use our service. This is the Account Registration Data category described in our Privacy Policy.

2. Personal data collected through your use of the Open Time Clock Service - when you use the Open Time Clock Service, we collect personal data about your use of our service such as but not limited to username, complete name, company name, email address, IP address, and GPS location so we can categorized your concern and have a concrete and immediate resolution to your queries. This is the Open Time Clock Service Usage Data category contained in our Privacy Policy.

3. Personal data collected that enables us to provide you with additional features/functionality - from time to time, you may also provide us with additional personal data or give us permission to collect personal data e.g. to provide you with more features or functionality. These are Sample Time Sheet Records, Payment Data, Surveys, and Marketing Data categories contained in our Privacy Policy.

Why does Open Time Clock collect and use this personal data?

We collect and use your personal data for the following reasons:

• to provide, personalize, and improve your experience with the Open Time Clock Service. Specifically, we use your information to help you complete a transaction or order, to provide service and support, to update you on services and benefits, and to personalize promotional offers;

• to understand how you access and use the Open Time Clock Service to ensure technical functionality of the Service, develop new products, features and services, and analyze your use of the Opentimeclock.com Service;

How does Open Time Clock protect my personal data?

Open Time Clock is committed to ensuring the security of your information. To prevent unauthorized access or disclosure, maintain data accuracy, and ensure the appropriate use of the information, Open Time Clock has appropriate physical, managerial procedures to safeguard the information we collect. We have implemented various policies including pseudonymization, encryption, access, and retention policies to guard against unauthorized access and unnecessary retention of personal data in our systems.

Your password protects your user account, so we encourage you to use a unique and strong password, limit access to your computer browser and other devices, and log out after having used the Open Time Clock Service.

How long we store your history time cards data?
(Retention period of the clocking data)

Our system was designed to store your history time cards data for 5 years. You can inform us through phone call, email or live chat to ask us to store for longer time if you need.

You can also ask us to delete all your data imediately and permanently if you want.

How does Open Time Clock share / transfer my personal data?

We do not and will not provide any of your personal or business information to other companies or individuals without your specific request and permission.

Personal data collected for the purposes of paying your subscription through our payment partners (PayPal and PayPro Global) within the European Union (“EU”) and Switzerland may, for example, be transferred to us and processed by third parties located in a country outside of the EU and Switzerland. In such instances Open Time Clock shall ensure that the transfer of your personal data is carried out in accordance with applicable privacy laws and in particular that appropriate contractual, technical, and organizational measures are in place such as the Standard Contractual Clauses approved by the EU Commission.
